1. Who operates the Site
The website e-vitalmarket.com ("the Site") is operated by I.D. Francesca Atelier SRL, CUI RO39363559, Trade Register no. J40/10333/2020, registered office at Str. Valea Cascadelor nr. 21T, hala 6-7, sector 6, 061512 București, România, telephone +40 726 000 008. "VitalMarket" is the company's trade name.
By using the Site you accept these terms. If you do not agree with them, please do not use the Site.
2. Purpose of the Site
The Site presents the company, the product families it has worked with, the manufacturers' documentation for those products and the company's experience. It lets you request information or a quote through the contact form, the assistant, telephone or WhatsApp.
The Site is not an online shop: no order can be placed, no payment is collected and no contract of sale is concluded through it. Any sale is agreed separately, in writing, after a quote.
3. Product information and reference prices
- Product descriptions, specifications and performance figures reproduce the manufacturers' documentation that accompanied the products (instructions for use, declarations of conformity, brochures). Where a document could not be recovered from our archive, the product page says so.
- Some pages mention 2022 list prices for reference only. They are historical, may have been shown without VAT where the law allowed it at the time, and do not constitute an offer. A current price requires a quote.
- Items marked "historic catalog item" were out of stock at the last catalog update (2022). The availability of any product must be confirmed with us.
- We correct errors as soon as we become aware of them, but we do not guarantee that every page is complete or up to date at all times.
4. Medical and safety notice
The rapid tests and the other in-vitro diagnostic devices presented on the Site are professional-use products: sampling and the interpretation of results must be carried out by qualified medical staff. Food supplements do not replace a varied diet; read the label and consult a doctor for specific conditions. Disinfectants must be used according to the manufacturer's instructions. Nothing on the Site constitutes medical advice.
5. The assistant
The VitalMarket Assistant is an automated tool that answers from our documentation. Its answers may be incomplete or wrong, do not constitute medical, legal or commercial advice and do not bind the company. Do not enter sensitive data. We may limit or suspend the assistant at any time.
6. Intellectual property
The texts, structure, graphics, the VitalMarket logo and the photographs on the Site belong to the company or are used with permission; manufacturers' trademarks, product names and documents belong to their respective owners. You may consult and print pages for personal information or for internal business use. Reproducing, distributing or using the content of the Site commercially without written permission is prohibited (Law no. 8/1996 on copyright and related rights).
7. Liability
The Site is provided "as is". To the extent permitted by law, the company is not liable for damage resulting from the use of the Site, from its temporary unavailability, from reliance on information that proved inaccurate, or from third-party websites linked from the Site. Nothing in these terms limits liability that cannot be limited under Romanian law, including consumers' rights.
8. Acceptable use
You agree not to use the Site or its forms to send unlawful, abusive or misleading content, to attempt unauthorised access, to overload the service, or to extract data automatically beyond what robots.txt allows.
9. Personal data and cookies
The processing of personal data is described in the Privacy Policy; cookies and similar technologies are described in the Cookie Policy. Both form part of these terms.
10. Consumers
If you are a consumer, you may submit complaints to the National Authority for Consumer Protection (ANPC), use the alternative dispute resolution mechanism (anpc.ro/ce-este-sal) or the EU online dispute resolution platform (ec.europa.eu/consumers/odr).
11. Applicable law
These terms are governed by Romanian law. Disputes that cannot be settled amicably are submitted to the competent courts of Bucharest, without prejudice to consumers' right to bring proceedings before the courts of their own domicile.
